Terms of Service

1. Agreement

These terms govern your use of valueinfinity-ds.com and its subdomains (the "Site"), operated by ValueInfinity Digital Services ("ValueInfinity", "we", "us"). By using the Site you agree to them. If you do not agree, please do not use the Site.

Note for the site owner: replace this paragraph with your registered legal entity name, company registration number and registered address, and confirm the governing-law clause in section 11 with a qualified adviser before publishing.

2. What this covers, and what it does not

These terms cover the Site only. They do not cover:

• Our mobile applications, which are governed by their own end-user licence agreements and the terms of the store you downloaded them from.
• Client engagements, which are governed by a separate signed contract. Where that contract and these terms conflict, the contract wins.

3. Using the Site

You may browse the Site and contact us through it. You agree not to:

• Use the Site for any unlawful purpose, or in breach of these terms.
• Submit content that is unlawful, defamatory, abusive, or infringes anyone's rights.
• Attempt to gain unauthorised access to the Site, its servers, or any connected system.
• Interfere with the Site's operation — including by automated flooding of the contact form, denial-of-service attempts, or circumventing rate limits or anti-bot measures.
• Scrape, harvest or systematically extract content except as a search engine operating within our robots.txt.
• Misrepresent your identity or affiliation when contacting us.

We may suspend or block access where we reasonably believe these terms have been breached.

4. Enquiries and no offer

The Site describes services we offer. Nothing on it is a binding offer, a quotation, or a commitment to take on any particular project. A contract between us arises only from a separate written agreement signed by both parties.

Sending an enquiry creates no obligation on either side. We may decline any project for any lawful reason, and we will normally tell you promptly if we are declining.

5. Confidentiality of what you send

We treat the substance of your enquiry as confidential and will not disclose it to third parties other than the processors listed in our Privacy Policy. However, an unsolicited enquiry through a public web form is not a substitute for a signed non-disclosure agreement. Do not send trade secrets, credentials, or material you cannot afford to have in an ordinary email inbox. If you need an NDA in place first, say so in your message and we will arrange one before you share detail.

6. Intellectual property

The Site — its text, design, code, graphics, logos and the ValueInfinity name and marks — belongs to ValueInfinity or its licensors and is protected by copyright and trade mark law.

You may view the Site and print or download extracts for your own non-commercial reference. You may not otherwise reproduce, republish, distribute or commercially exploit any part of it without our written permission.

Third-party names, marks and product names mentioned on the Site belong to their respective owners, and their use here is descriptive only.

Ownership of work produced under a client engagement is determined by that engagement's contract, not by this section.

7. Third-party links and services

The Site links to third-party sites, including our applications' own websites and the app stores. We do not control those and are not responsible for their content, availability or practices. A link is not an endorsement. Your use of a third-party service is governed by that service's own terms.

8. Availability

We aim to keep the Site available, but we do not guarantee uninterrupted or error-free access. We may change, suspend or withdraw all or part of it without notice, including for maintenance. We are not liable for the Site being unavailable at any time.

9. Disclaimer

The Site and its content are provided "as is". To the fullest extent permitted by law, we exclude all warranties, express or implied, including fitness for a particular purpose and non-infringement.

Content on the Site is general information, not professional advice for your particular situation. Do not rely on it as a substitute for advice about your own project.

10. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for any indirect, incidental, consequential or special loss, nor for loss of profit, revenue, business, goodwill or data, arising from your use of the Site.

If you are a consumer, these terms do not affect your statutory rights.

11. Governing law

These terms and any dispute arising from them are governed by French law. The competent courts of France have jurisdiction, without prejudice to any mandatory protection you enjoy as a consumer under the law of your country of residence.

12. Changes to these terms

We may update these terms. The version published here at the time you use the Site is the one that applies, so please check the "last updated" date. Continued use after a change means you accept the updated terms.

13. Severability and entire agreement

If any provision is found unenforceable, the rest remains in force. These terms, together with the Privacy Policy, are the entire agreement between us regarding the Site.
